NOTICE REGARDING DISPUTE RESOLUTION: These Terms of Use contain provisions that govern how claims you and we may have against each other are resolved (see Section 20 below), including an agreement and obligation to arbitrate disputes, which will, subject to limited exceptions, require you to submit claims you have against us to binding arbitration, unless you opt out in accordance with Section 20. Unless you opt out of arbitration:
(a) you will only be permitted to pursue claims against us on an individual basis, not as part of any class or representative action or proceeding; and
(b) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.

1. Acceptance of Terms

These Terms of Use (“Terms”) are entered into by and between you and Sara Hotels LLC dba The Amaya (“Amaya,” “Company,” “we,” or “us”), with its principal office located in Fort Wayne, Indiana (Allen County). These Terms govern your use of our offline and online services, any content or information therein, including theamaya.com and any related subdomains or digital services provided by us (collectively, the “Website” or “Digital Access”).

By accessing and using the Website, you agree, on your own behalf and on behalf of any corporation or legal entity that you represent, to be bound by these Terms and all applicable laws and regulations. If you do not agree, you are not authorized to use the Website.

2. Changes to These Terms and the Website

We may revise these Terms at any time, effective immediately upon notice (including posting updated Terms on the Website). Your continued use of the Website after changes become effective constitutes acceptance.

We also reserve the right to modify or discontinue any aspect of the Website, including services, content, and features, without notice.

8. Promotions & Errors

Promotions, offers, and reservations are subject to their specific terms and may be modified or withdrawn at any time. The Website may contain inaccuracies (including pricing or availability errors), and Amaya reserves the right to cancel or correct such errors.

9. Submissions

By submitting feedback, comments, or content to us, you grant Amaya a worldwide, royalty-free license to use, copy, distribute, display, and create derivative works for business purposes.

We implement reasonable security measures, but we do not guarantee complete confidentiality or that transmissions will be secure. You are responsible for maintaining the confidentiality of login credentials.

11. AI Disclosure

Travel involves inherent risks. Amaya does not represent or warrant that accommodations or travel to certain destinations are advisable or without risk.

14. Electronic Communications & Mobile Services

By using our Website or services, you consent to receive electronic communications from us, including SMS, emails, or push notifications. Standard carrier rates apply.

15. Reservations – General Terms

  • Cancellation policies vary by rate and are displayed at booking.
  • Pets are not allowed. Service animals are welcome and must comply with ADA requirements.
  • Group bookings exceeding 10 rooms require direct arrangements with Amaya.
  • Special rates (AAA, government, etc.) require proof at check-in.

16. Disclaimer

THE WEBSITE AND CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. AMAYA DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

17. Limitation of Liability

To the fullest extent permitted by law, Amaya and its affiliates are not liable for indirect, incidental, consequential, or punitive damages arising out of use of the Website or services. Maximum liability shall not exceed $100 in any calendar year.

18. Indemnification

You agree to indemnify and hold harmless Amaya and its officers, employees, and affiliates from any claims, damages, or costs arising from your violation of these Terms.

19. Governing Law

These Terms are governed by the laws of the State of Indiana.

20. Arbitration & Waiver of Jury Trial

Any dispute arising out of these Terms shall be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”).

  • Arbitration will take place in Allen County, Indiana.
  • You may opt out within 30 days of first use by notifying:

Unless you opt out:

  • You waive the right to a jury trial.
  • You waive the right to participate in any class or representative action.

21. Miscellaneous

  • These Terms and the Privacy Policy are the entire agreement between you and Amaya.
  • If any provision is held invalid, the remainder remains enforceable.
  • Any claims must be brought within one (1) year of occurrence.
  • Discontinuing Website use is your sole remedy if dissatisfied.
